YouTube will label brand deals you don't declare, and the label covers the whole video

YouTube's September 3, 2026 branded content update replaces the paid promotion label, adds per-country age and location controls, and brings automated detection that can label an undeclared brand deal for you — with the whole video in scope.

YouTube published the change on September 3, 2026. The refreshed disclosure label is already rolling out to viewers, and the new age and location controls are switched on in YouTube Studio. The sharpest part is still ahead: in "the coming months", YouTube is turning on automated detection that can label an undeclared brand deal for you. 1
The disclosure duty reaches further than the minutes a sponsor paid for. The rewritten policy applies to the entirety of a video, so a ninety-second integration pulls the whole twenty minutes into scope. 2
Everything here concerns labels, the ads sold against a video, and a channel's eligibility for the Partner Program. Recommendation is a separate system, and YouTube's announcement makes no change to it. 1

Does this reach your channel

The declaration duty follows the content. A channel far from the Partner Program can still owe YouTube a declaration for a video it published.
  • You are paid by a brand, or given free product. This reaches you. YouTube counts any benefit of value, and it counts a benefit you receive later as well as one you receive now. 2
  • A sponsor's name shows up in a description, a comment, a live stream, or a Short. This reaches you too: the policy covers branded content wherever it appears on YouTube, and not only inside the video file. 2
  • You have never worked with a brand. None of the new settings appear in your Studio until you declare a video, so nothing about your routine changes. 3

What YouTube changed

Four things moved on September 3, and they stand at different stages.

When YouTube applies the label for you

When YouTube's systems judge that a newly uploaded video contains branded content the creator did not declare, YouTube may apply the branded content label to the video and notify the creator. 2
The route back is conditional. The policy says a creator who believes the label was applied in error "may have the option to certify that your video does not contain branded content and override the label". Neither the policy page nor the announcement describes what the detection reads, how accurate it is, or where the certification appears in Studio. 12
Responsibility stays where it was. YouTube's announcement describes detection as an aid and states that the creator remains responsible for making disclosures comply with local law. 1

The controls you now have

Declaring a video as paid promotion unlocks three settings that used to be absent:
  • the geographic locales where the video can be shown;
  • the overall minimum age to watch it;
  • the minimum age to watch it in specific locales. 2
Minimum ages start at 18 and run up to 25 and over, and you edit them in YouTube Studio on a computer. The options appear only after you select Yes under Paid promotion. 34
YouTube gives a commercial reason for building the controls alongside the legal one. The announcement says the settings mean you "won't have to pass on a brand partnership because of strict demographic or regional constraints", and it points to food marketing rules in the United Kingdom and advertising regulations in the United States as the kind of national rule these controls are built to accommodate. 1
The settings are manual, which sets what they can do for you. They apply a restriction you already know you need; they do not tell you which markets regulate the product in your deal, and the declaration flow raises no warning when the category you are promoting is restricted in a given market. 3

What counts as branded content

YouTube defines branded content as any content on the platform influenced by a brand partner in exchange for something of value, including payment, free products, and sponsorships, whether the benefit arrives now or later. 2
Two clauses settle the scope of a placement. The policy applies to branded content wherever it appears, which includes videos, descriptions, comments, live streams, and Shorts. It also applies to the entirety of the content rather than to the sponsored portion alone. 2
Some goods cannot be promoted at all in branded content: recreational drugs and paraphernalia, weapons and ammunition, hacking software, counterfeit products, and academic essay-writing services. A second group is restricted rather than banned, covering alcohol, financial services, healthcare and medicines, gambling, and elections and political content. Deals in that second group leave you confirming that the brand partner holds Google's certification where it is required, and setting the age and country limits your market demands. 2

What stays as it was

Branded content keeps its access to ad revenue. A video remains eligible if the channel is in the Partner Program and the content follows the advertiser-friendly guidelines, and ads still run on it. One thing changes around those ads: YouTube may swap out an ad for a direct competitor of your sponsor, which the policy frames as protecting the sponsorship you have and the value YouTube offers advertisers. 2
Declaring keeps taking a video out of the YouTube Kids app, and the rewritten policy restates that rule. 2
YouTube presents the rewritten policy as a matter of naming and explanation. The announcement says it "does not introduce any dramatic changes", gives the policy its industry name, and makes the Google Ads policies an explicit part of the branded content rules. 1
A separate declaration sits untouched in the same Studio panel. Since October 10, 2025, a creator declaring that a video contains an EU political paid promotion makes that video unavailable to viewers in the European Union, and that declaration keeps its own requirements. 3

The one action

Declare the brand deal before you upload. In Studio the declaration sits under Paid promotion in the video details, and on mobile under Products, Paid promotion, and brands; selecting Yes is what adds the disclosure label and opens the age and location settings. 3
Declaring it yourself keeps the label a decision you made rather than one applied to your channel on YouTube's behalf, and it is the only step available to you before automated detection reaches the upload. 1
While you are in Studio, walk back through what is already published — sponsor reads, gifted-product segments, and "thanks to" tags in older videos and Shorts — and add the declaration wherever it is missing. The Help Center gives the same steps for an existing video as for a new one. 3
