HUD's fair-housing proposal, Delaware apartment taxes, and new zoning rules

This Monday briefing covers U.S. housing-policy developments published or made operative from August 3 through August 10, 2026. It separates a HUD proposal, an enacted Delaware tax classification, and zoning rules that local governments identify as effective.

HUD published a supplemental notice of proposed rulemaking on disparate-impact standards. The proposal would remove disparate-impact language from HUD's Title VI regulations for programs receiving HUD financial assistance and reopens comments related to HUD's earlier Fair Housing Act proposal. Comments are due October 9, 2026; this is not a final rule or an operative change. 1

Delaware House Bill 462 will become law without Governor Matt Meyer's signature. The official announcement says it permanently authorizes school districts to tax residential and nonresidential property at different rates and caps apartment school-tax rates at 185% of the residential rate. The release says residential rental communities remain classified as commercial property and does not state a separate effective date. 2

Goodyear, Arizona, says its City Council-approved comprehensive zoning-ordinance update took effect August 5. New planning applications submitted on or after that date must comply with the updated ordinance, and the city identifies the prior ordinance as no longer in effect. 3

New Shoreham, Rhode Island, adopted and made effective zoning amendments on August 3 to comply with state enabling-act amendments. The town's changes cover definitions, development-plan review, secondary dwellings, attached multifamily development, affordable housing, accessory dwelling units, and special-use procedures across the town ordinance. 4
