Web3 Weekly: October 12–19, 2026 — Missouri's cease-and-desists draw two lawsuits as venture funding falls to $20 million

An October 12–19 briefing on Missouri's cease-and-desists becoming two federal lawsuits, a judge refusing to vacate Gemini's settlement, France's 38–37 vote to tax stablecoin swaps, $20 million in fresh venture money, and Glamsterdam's Hoodi activation date.

The seven days from October 12 to October 19, 2026 produced no crypto enforcement action from the U.S. Securities and Exchange Commission, no crypto rulemaking from the Commodity Futures Trading Commission, and no new instrument under Europe's MiCA regime. The week's rulings arrived somewhere else.
Missouri's attorney general gave six prediction-market operators thirty days to stop selling sports event contracts in September. Two of them sued her in federal court on Friday 1. A federal judge in New York refused to erase a settlement both the regulator and the company wanted gone 2. France's National Assembly passed a tax amendment by a single vote 3.
The money got smaller and more specific. Three disclosed rounds in the window come to $20.0 million, against $159.5 million the week before, and two of them sell liquidity for tokenized positions 4.
The infrastructure calendar tightened. The Ethereum Foundation fixed Glamsterdam's Hoodi activation at October 26, 17:42:48 UTC, with mainnet still undated 5. Bitcoin traded near $81,000 midweek after a hotter inflation print and had recovered to about $82,000 by Monday morning 6.

Web3 financing and capital deployment

Fresh venture money disclosed between October 12 and October 19 comes to $20.0 million across three rounds, down from $159.5 million the week before. The count of new companies barely moved; the size of the checks did.
Two of the three are built on the same observation: tokenized assets can take days or months to turn into cash. The demand being funded is a faster exit at a known price.
Fission — $10 million Series A (October 15). Pantera Capital led the round, which closed in September, with Circle Ventures, Borderless Capital and Ari Rubenstein participating 4. The New York company, founded in 2024 by Point72 and Securitize veterans, acts as the buyer of tokenized fund shares: an investor connects a wallet, submits a sale, and Fission handles the legal and trading work behind it 4.
Chief executive Jonathan Shaffer put the pitch at roughly 200 days to sell such a product conventionally, against settlement in 90 seconds or less for a fee 4. Customers are mostly hedge funds with tokenized private-credit or equity holdings, crypto treasuries and stablecoin issuers; the company has eight employees and did not disclose its valuation 4. The Series A follows a $1.6 million pre-seed led by SALT Fund and Kraynos Capital 4.
Multiliquid — $8 million across pre-seed and seed (October 15). Polychain led the seed, with Strobe Ventures, CMT Digital, Metalayer Ventures, Generative Ventures and Circle Ventures participating 22. Founder and chief executive Will Beeson said the pre-seed was raised between May and June 2025 through a SAFE and the seed between April and June 2026 as priced equity, without disclosing how the $8 million splits or at what valuation 22.
The platform converts tokenized assets into stablecoins, or the reverse, in a single atomic transaction on Ethereum or Solana, at net asset value 22. It supports funds from Wellington Management, VanEck, Janus Henderson and Fasanara, charges basis-point fees on completed conversions, and has five employees 22. Beeson gave no figures for volume, assets settled or clients.
Spout — $2 million strategic round (October 16). The Solana-based lending protocol lets users pledge tokenized U.S. equities and borrow USDC at 0% interest, with the lender return generated by selling covered calls against the collateral 23. Its beta runs on Solana's devnet.
Reconciling the number with the tallies. A weekly crypto funding tally put disclosed financings at $51.4 million across six deals for October 10 to 16 24.
Two adjustments make it comparable to the $20.0 million above. Its window opens two days before this issue's, and the largest item in it is not equity: the Sui Foundation's $30 million commitment to DATA Network, dated October 12 13. Strip that out and the remaining five financings total $21.4 million, of which the three rounds dated inside this issue's window account for $20.0 million 24.
Foundation capital, kept separate. The Sui Foundation's $30 million investment in DATA Network is the week's largest single cheque and belongs in its own bucket: it buys a migration, not a stake in a private company 13. DATA Network, the rebranded Story Protocol, plans to retire its independent blockchain and move its AI training-data registry onto Sui, with Walrus as the default storage layer for its applications 13.
Existing DATA tokens migrate at 1:1, and locked positions and vesting schedules carry over unchanged, the two foundations said.
No migration date has been announced, the valuation and token allocation are undisclosed, and it is not established whether the full $30 million has been transferred 13. The foundation reports more than 250 million contributions registered on its Trace system and more than 3 million receipts a day; those figures are its own and were not independently audited 13.

Regulatory actions and market structure

Missouri's cease-and-desists become two lawsuits

Attorney General Catherine Hanaway sent letters on September 16 and 17 to six operators, giving each thirty days to stop offering sports event contracts to Missouri residents or to obtain a licence from the Missouri Gaming Commission and pay the state's 10% wagering tax 1. Her letter to Crypto.com added that the platform lets users as young as 18 trade, while Missouri's minimum age for sports betting is 21 1.
Two of the six went to court on Friday. North American Derivatives Exchange, the CFTC-registered exchange behind Crypto.com's prediction markets, filed in the Western District of Missouri, arguing that the Commodity Exchange Act gives the CFTC exclusive jurisdiction and preempts state gambling law 1.
The complaint says Hanaway addressed her letter to Foris DAX, Inc. rather than to the exchange, and that a state licence is not an option because Missouri's constitution allows only two direct mobile sports wagering licences and both have been awarded 1.
Novig filed in the Eastern District through its exchange operator, Ludlow Exchange LLC, seeking a preliminary and permanent injunction; it has brought similar suits in other states 1. Kalshi, Polymarket, Robinhood and Underdog received the same letters and had not filed in either Missouri district as of Sunday, according to court records The Block reviewed 1.
For operators, the deadline structure matters more than the argument. A licence application is not available to Crypto.com on its own account, and the thirty-day clocks have expired. Whether the contracts may be offered in Missouri now depends on a judge granting an injunction.

A settlement that a friendly regulator could not undo

Judge Alvin Hellerstein rejected a joint request from Gemini and the CFTC to overturn the exchange's $5 million settlement, ruling on Thursday that the agency's decision to reverse its position on the case was not enough to undo a January 2025 agreement 2. He also rejected Gemini's argument that regulators had coerced it into settling.
Gemini has already paid the $5 million. What survives is the court order barring the exchange from misleading the CFTC or publicly denying the settlement's findings, and it binds as the company shifts its business toward the United States 2. The case began in 2023 over whether Gemini misled the agency during a 2017 review of a proposed bitcoin futures contract; it settled three weeks before trial without admissions 2.
The ruling sets a limit on what a change of administration can deliver. A case both parties agree should never have been brought stays on the record when the settlement has already been performed.

Paris taxes the swap, 38 votes to 37

France's National Assembly adopted a 2027 budget amendment on Friday that ends tax deferral for swaps into single-currency stablecoins from January 1, 2027 3. The vote was 38 to 37.
The mechanism is what matters for anyone holding a euro or dollar stablecoin in a French taxable account. A swap from a crypto asset into a stablecoin has been treated as a deferral event rather than a disposal; from January the disposal is recognised at the point of the swap 3.
The amendment is part of the 2027 budget and still faces further parliamentary stages, so the January 1 date is a plan, not a settled fact 3.

Riga taxes withdrawals above deposits

Latvia's parliament passed legislation on October 15 that taxes withdrawals from crypto investment accounts once they exceed the amount deposited, rather than taxing each trade 7. The law adds a one-time declaration: holders settle past obligations by paying 10% of their declared assets' market value at the end of 2026, filing between April 1 and May 31, 2027, with the tax due by July 23 7.
A prime ministerial adviser, Didzis Dejus, said the Finance Ministry has agreed to let residents pay personal taxes in crypto as early as next year, with technical work on a payment provider outstanding 7. That plan depends on the next coalition forming, so treat the payment route as an intention and the withdrawal tax as law.

Australia starts its licensing clock

ASIC opened a consultation on October 15 on standards for crypto exchanges and digital asset custodians, covering segregation and safeguarding of client assets, trading transparency, settlement, financial resources, market manipulation and conflicts of interest 8. The consultation closes on November 27, with final guidance expected in March 2027.
Two dates follow. The rules take effect on April 8, 2027, and firms already operating have until October 7, 2027 to apply for a licence while continuing to trade during ASIC's review 8. ASIC says it has recorded more than 140 applications for digital asset-related financial services authorisation, and that stablecoins used for payments are being handled separately through the payment services reforms 8.

Turkey arrests Hex's founder on a Finnish tax notice

Turkish police detained Richard Heart in Istanbul on an Interpol notice, and the justice ministry confirmed the arrest on Saturday, saying officers seized $7.15 million and six cold wallets along with watches, jewellery, ammunition and guns 9. His wife and three bodyguards were also detained.
Interpol's public record names Finland as the requesting jurisdiction and lists aggravated tax fraud, which is separate from the SEC case against Heart that was dismissed in 2025 25. The seizure figure is the one to note: this is an asset-attachment action attached to a tax charge, not a market-conduct case.

Hyperliquid argues for regulating the operator, not the chain

Hyperliquid founder Jeff Yan told Bloomberg that U.S. rules should apply to the firms operating markets on his blockchain rather than to the network itself, because "the regulation sits at the layer where there are controls" 26. Hyperliquid's perpetual futures market remains closed to U.S. customers.
The proposal has a live test case. Kraken's parent, Payward, plans to offer U.S. investors derivatives built on Hyperliquid's technology through a regulated exchange, which would give the network a CFTC-regulated operator without opening the perps venue itself 26. For a founder weighing where to put a regulated venue on a permissionless chain, that is the template to watch.

The three agencies that published nothing

The SEC's newest press release in the window is a notice that its Small Business Advisory Committee will discuss IPO modernisation and Regulation Crowdfunding, dated October 14 27. The releases before it cover cross trading by registered funds, a cherry-picking judgment and a compliance seminar. None is a crypto action 10.
The CFTC's newest releases remain the October 9 pair on event contracts, and nothing dated October 12 to 19 appears on its press-release index 11. That leaves the crypto rulemaking notice of October 5 as the agency's live item, with its 60-day comment period still running from Federal Register publication 28.
ESMA's news surface carried the European Supervisory Authorities' 2027 priorities, the 2026 common enforcement priorities, transparency guidance, a sanctions report, a Q&A batch and T+1 settlement messaging. No MiCA technical standard, passporting decision or individual CASP supervision action appeared 12. The one crypto item in the October 16 batch is a re-listing of an answer dated October 6 on where a CASP may hold client funds 29.
The answer is narrow and operational, and it applies to firms today. A CASP may hold client funds temporarily in an account at a non-bank payment service provider, but must move them to a credit institution or central bank by the end of the next business day 30.
An account opened in the payment provider's own name does not satisfy MiCA even if it is dedicated to the CASP and segregated, because the firm would hold a claim on the provider rather than being the account holder 30.
The White House's digital assets office is also vacant, after adviser Patrick Witt's departure left its policy aims uncertain 31.

Lending vaults pass $10 billion

Crypto lending vaults have passed $10 billion in deposits, up from $4 billion at the start of last year, according to Financial Times reporting CoinDesk cites 32. Curators select strategies, set risk limits and take fees, with returns usually between 3% and 10% and riskier books reaching 20% or more 32. The SEC has raised questions about vaults holding securities, and European regulators have proposed oversight of intermediaries that provide access to DeFi 32.

Layer 2 networks and scaling

No Layer 2 network launched a mainnet or a public testnet in this window. One migration got a date, and one chain was sold a way out.
Unichain moves to OP Enterprise on October 29. Uniswap Labs said on October 9 that Unichain is moving to OP Enterprise ahead of native interoperability across the OP Stack, with the testnet migrating on October 13 and mainnet on October 29 14. Chain ID 130, contracts, balances, apps and the Uniswap v2, v3 and v4 deployments are described as unchanged.
The announcement predates this issue's window. October 29 has not happened, and the October 13 testnet line reported no result 14. Two things the note leaves open are the tier, Fully Managed or Self Managed, and when bridge-free ETH movement between Unichain and other OP Stack chains arrives; interoperability has no date 14.
DeFiLlama put Unichain's chain TVL at $26.4 million on October 17, against $443.5 million on OP Mainnet, and L2BEAT showed $86.67 million secured with 50.2% under additional trust assumptions 14. A change of operator at that size is an operations decision.
DATA Network is retiring its chain. The Sui Foundation's $30 million investment covers moving the AI training-data registry onto Sui, with no migration date announced and the existing chain operating until the transition completes 13. Abstract's December 15 shutdown and Blast's wind-down sit in the same quarter, three chains leaving within months for different reasons.

Protocol upgrades and infrastructure

Glamsterdam now has a Hoodi date: October 26, 17:42:48 UTC. The Ethereum Foundation published the schedule on October 16, setting activation at epoch 132,352, slot 4,235,264, and raising Hoodi's gas limit to 200 million at the same epoch through the gas limit schedule 5. Mainnet remains undated, and the Foundation says a separate announcement will cover it 5.
This resolves the item this channel carried last week as tentatively October 27. The substance is unchanged: enshrined proposer-builder separation under EIP-7732 moves the proposer-builder handoff into consensus and adds a payload timeliness committee, and block-level access lists under EIP-7928 record the accounts and storage each block touches so clients can read state and validate transactions in parallel 5. EIP-8037 and EIP-8038 reprice state creation and state access.
Both execution and consensus clients must be updated before activation, and the Foundation warns that contracts relying on fixed gas stipends or hardcoded gas limits may need changes 5. Consensus releases listed for Hoodi include Lighthouse v8.3.0, Prysm v7.3.0, Teku 26.10.1, Nimbus 26.10.1, Lodestar 1.50.0 and Grandine 3.0.0-rc.1; execution releases include Besu 26.10.0 and Nethermind 2.2.0, with Erigon and Reth not yet listed 5.
Injective fixed the gas cost of its exchange messages. Proposal IIP-709 took effect on October 17 at the end of block 187,720,178, switching the exchange module from per-transaction gas estimation to published costs for supported operations 15. A spot market order now carries 180,000 gas for the message, with a suggested 300,000-gas transaction budget including a 120,000-gas allowance for preliminary checks; a derivative market order carries 190,000 and a suggested 310,000 15.
Cancellations are cheaper: 65,000 gas for a spot order and 80,000 for a derivative. At the current base gas price those budgets imply fees of roughly 0.000048 INJ and 0.0000496 INJ respectively, though the fee still depends on the limit and price a user submits 15. Batch-order gas still scales with the number and type of orders, and IIP-709 changed only the fixed-gas switch, leaving trading fees untouched 15.
THORChain halted ZEC swaps and is waiting on v3.21. An outbound matching bug triggered a slash of a Zcash vault without losing funds, and swaps involving ZEC remain paused pending the v3.21 upgrade scheduled for around October 23 16. Onchain records show about 140 RUNE deducted from 18 node accounts.
The release is targeted at block 28,366,100, and the lending protocol Rujira plans to ask for a conditional 24-hour liquidation grace period for borrowers when it restarts 33. A slashed vault is a different failure from a drain: the bond absorbed the error, and node operators carry the cost.
Solana published a leader-schedule study for review. The October 14 note evaluates SIMD-0675, which reorders the stake-weighted random leader schedule so consecutive leaders sit geographically close, cutting handoff latency without changing any validator's number of leader windows 17. On 6,250 simulated networks built from today's 124 validator locations, the gain levels off quickly as run length grows while the risks rise — leaders concentrating in one region, and validators declaring false locations 17.

Pirate Chain's exploit came from two validation failures — a bypassed issuance check and an incorrect interpretation of output scripts — and the newly created coins went straight into a shielded pool, so their later movement cannot be traced 18. Exchange NonKYC spotted suspicious deposits and restricted the account; delayed-proof-of-work operators suspended notarisation as a precaution 18.
Pirate Chain's own update says the network's decentralised structure means the team cannot freeze it or roll back its history, and that the recovery plan is still being written 18. For holders, that is the operative fact: a supply expansion of about 20% with no remediation path yet announced.
Qubic's failure sat in the wallet; the response came from the chain. An attacker drained 1,404 wallets between 7:42 and 9:26 p.m. ET on October 17, and the network's Computors halted processing at tick 85,371,949 the next morning 19. Qubic said 87.1% of the drained funds were still on the network and immobilised by the halt, while the 12.9% sent to MEXC was frozen within about an hour 19.
The cause was seed generation. Qubic said the flaw sat in wallet seeds created with insufficient randomness, and that the protocol itself was sound.
Version 4.26.4 replaced a non-cryptographic random function with a secure one 19. Its warning covers seeds created in any browser on an iPhone or iPad before October 18, in Safari on a Mac before that date, or in the Qubic iOS app before July 2025 19. The Defiant's own valuation of the stolen tokens, using a CoinGecko price on October 18, came to about $1.26 million, and Qubic's figure of $1.3 million is a market valuation; the attacker's realised proceeds are unknown.
Cysic lost about $727,000 in four steps. An attacker minted 10 million CYS on BNB Smart Chain, sold 7.2 million, bridged the proceeds and received 306.6 ETH on Ethereum before the address was blacklisted, leaving about $727,000 out and roughly 2.8 million CYS frozen at the recipient address 20. Cysic suspended the bridge.
Ledger's problem widened and then got a product answer. Mark Karpelès reported implants in Ledger devices bought from two more resellers, Metapod and MediaMarkt, extending the incident beyond the Southeast Asian distributor named last week 21. Ledger said inspections of German stock found no tampering and that it has not verified a drain tied to a device bought outside Southeast Asia; its authenticity check cannot detect the added hardware 21.
On October 15 the company announced Atom, a device scheduled for mid-2027 that runs Android, can run ordinary phone apps, and switches into a protected mode for managing digital assets 34. It carries a protective enclosure around sensitive components, sensors that detect removal of the screen or back cover, and packaging that shows whether it has been opened, with a separate battery so detection works when the device is off 34.
Two commercial details answer questions the incident raised. Atom will initially be sold only through Ledger's own website, removing third-party distribution from the chain, and the company says it has no plans for a trade-in programme for customers affected by the breach 34.
Anyone holding a device bought through a regional reseller should still assume the earlier advice holds: do not initialise an unused device, and generate new keys on new hardware if one is already active.

Editorial view

The reading that follows is this outlet's, drawn from the events above; the events themselves are the sources' unless stated otherwise.
The week's binding rules were written outside the three agencies this channel tracks by name. Missouri's attorney general set a thirty-day clock in September, and the response arrived in federal court on October 16 1. A federal judge held that a regulator's reversal cannot undo a performed settlement 2. France's assembly moved a tax date by one vote, and Latvia's parliament replaced a per-trade tax with a withdrawal tax 37.
Those four processes run on separate clocks and answer to different electorates. A firm planning its 2027 compliance calendar now has more hard dates from state courts and national tax laws than from the federal agencies, and each of those dates is reversible by a different event: an injunction, an appeal, a budget vote, a coalition.
The capital told a narrower story than last week's. Three rounds and $20 million, with two of them buying liquidity for tokenized fund positions and the third lending against tokenized stocks 42223.
The largest cheque of the week came from a foundation paying $30 million for a network to retire its chain and move its registry 13. Both patterns point at the same market: tokenized assets that exist onchain and still cannot be moved quickly, and the infrastructure being built to fix that.
The infrastructure calendar is now dense enough to plan around. Hoodi activates on October 26, THORChain's fix targets around October 23, and Unichain's migration is set for October 29 51416. Three dates in nine days, each requiring a different operator to do a different thing, and only one of them published with a full client matrix.

Follow-up by role

Founders and operators. If any part of your product touches a French taxable account holding stablecoins, the swap into a single-currency stablecoin becomes a disposal event from January 1, 2027 unless the budget process changes it 3. If you operate a Layer 2, Unichain's October 29 move shows what a change of production operator looks like when the chain ID, contracts and balances stay put; ask which tier you are on and who holds the sequencer 14. If you run event contracts, the Missouri letters are a template other state attorneys general can copy, and the preemption argument is the one being tested 1.
Investors and deal teams. $20.0 million across three rounds is the equity number, and $10.0 million of it went to one company that sells exits from tokenized funds 4. Compare that with last week's $159.5 million before drawing a conclusion about the market: one week is a small sample, and the composition matters more: two of the three rounds sell liquidity for tokenized positions. The Sui Foundation's $30 million belongs in a foundation-capital column, not a venture one 13.
Compliance teams. ESMA's answer on client funds is the most quotable rule of the week: holding client money at an e-money or payment institution is temporary, and an account in the provider's name fails MiCA even when it is segregated and dedicated 30. If you serve Australian clients, the licensing dates are April 8, 2027 and October 7, 2027, with the consultation closing November 27 8. If you have Latvian clients, the declaration window is April 1 to May 31, 2027, with tax due July 23 7.
Node, validator and staking operators. Hoodi is the actionable one: update both the execution and the consensus client before October 26 at 17:42:48 UTC, review the new proposer-builder duties, and set the gas limit your validators target after activation 5. On THORChain, the v3.21 window is around October 23 at block 28,366,100, and ZEC swaps stay paused until it lands 33. If you run a Solana leader schedule, the SIMD-0675 study is a model of a proposal with its risks stated; nothing has been activated.

Watchlist

  • Glamsterdam on Hoodi, October 26 at 17:42:48 UTC, epoch 132,352, with the gas limit rising to 200 million at the same epoch and mainnet still undated 5.
  • THORChain v3.21 around October 23, targeted at block 28,366,100, and whether ZEC swaps resume without a further halt 16.
  • Unichain's October 29 mainnet migration to OP Enterprise, and whether the tier and the interoperability date get published before it happens 14.
  • The two Missouri suits. Watch for a ruling on preliminary injunctions and for whether Kalshi, Polymarket, Robinhood or Underdog file 1.
  • France's 2027 budget, which still has parliamentary stages to clear before the January 1 stablecoin-swap date is settled 3.
  • Australia's CP 392 consultation, closing November 27, with final guidance due March 2027 8.
  • DATA Network's migration schedule and holder instructions, which the two foundations said they would publish before the upgrade begins 13.
  • Pirate Chain's recovery plan and whether any rollback or burn mechanism emerges from a network whose team says it cannot freeze the chain 18.
  • Ledger's reseller review and the Atom launch in mid-2027, plus whether the company publishes a device count for the CryptoBilis cases 34.
  • ESMA's three-month stablecoin remediation clock, carried from earlier issues, which ends January 8, 2027 35.
