Lincoln, Buffalo and Huntsville clear the spread; the zone map decides the rest

A 60% occupancy screen clears Lincoln, Buffalo and Huntsville, with Lincoln holding the widest cushion; zoning district approval and permit timing decide all three, and every 30-day decision stays at WAIT.

Three American cities still clear a leveraged short-term-rental spread this week: Lincoln, Nebraska, Buffalo, New York, and Huntsville, Alabama. All three stayed legal for a leased, non-owner-occupied unit, and all three now hinge on the same question — whether the specific address you lease sits on the right side of a zoning line.
Two of them carry a caution flag. One is as clean as a file gets. None of them is a green light yet, and the reasons are different in each city.

Regulation weather: September 13–20

Three cities moved on short-term rentals in the past seven days, and every move ran against the whole-unit operator.
Duluth, Minnesota removed the option that made the city work. On Monday, September 15, the city council voted unanimously to bar short-term rentals in single-family homes and to start enforcing against unlicensed operators. About 200 vacation dwelling units hold licences; the city estimates more than 400 other properties are operating without one. A 110-licence cap already applies, with no cap inside form districts such as downtown, Lincoln Park and Spirit Valley. Licensed single-family rentals may keep operating until the property sells or changes use. 1
South Bend, Indiana passed two bills on Monday, September 14. One requires every short-term rental owner to register with the city and leave a round-the-clock contact. The second requires a zoning special exception, and that is the one that decides whether arbitrage works there: owner-occupied rentals are exempt from it. Between 1,000 and 1,300 existing rentals are grandfathered. Both bills take effect January 1. 2
Santa Barbara, California took up its ordinance on September 15. The city council considered new chapters to Title 30, the inland zoning ordinance, and Title 28, the coastal one, creating a licensing process and operating standards for short-term rentals and homeshares — the first time the city has said where vacation rentals are legal and how they may run. 3
Any operator holding a Duluth single-family unit should read the September 15 ordinance before the next renewal. South Bend's special-exception requirement lands on exactly the operator who leases a unit they do not live in.

What cleared the screen

Every week this channel runs the same filter against mid-sized North American metros: population between 100,000 and 800,000, market nightly revenue at 60% occupancy above 1.35 times the local two-bedroom rent, a regulation light of green or yellow, and at least one operator publicly running three or more units profitably in the past year.

Huntsville, AL233,627 10$1,110 11$128 1260% 12$2,304$1,499YELLOW
Providence, Rhode Island failed the filter on its own numbers. Active listings there grew 178.8% year over year to 4,135 while occupancy stayed flat at 58%, and AirDNA's Market Score for the city sits at 48 out of 100. That is a market absorbing supply far faster than demand. 13
Assumptions behind every figure below. One 2BR unit, listed 365 nights a year, modelled at 60% occupancy — 18 booked nights a month. The nightly rate is AirDNA's market average daily rate across all bedroom counts, because AirDNA's public market page does not break out two-bedroom pricing. Cleaning fees are left out of revenue and matched against the cleaner's invoice instead. Rent is Zillow's average asking rent for a two-bedroom apartment. The unit is furnished for $6,000 and that is amortised over 24 months. Insurance is a commercial host policy. Lodging tax is treated as a pass-through collected from the guest, which means you need to check whether the platform collects it locally — if it does not, you add it to your nightly price or absorb it.

Lincoln, Nebraska

Where to look. The Haymarket and the downtown core hold the state capital's office cluster, the Railyard and Memorial Stadium inside a walkable grid, which is where the city's event and game-day nights land. 14 The blocks around the university's City Campus run on the academic calendar: the University of Nebraska system brought in 7,987 first-year students this fall, 163 more than in 2025. 15

Regulation gate. Lincoln licenses short-term rentals under Chapter 5.39 of the municipal code. Each unit needs its own licence, issued through Building and Safety at $250 a year. 16 Short-term rental is a conditional permitted use in AG, AGR, R-1 through R-8, O-1 through O-3, R-T, B-1 through B-5 and H-1 through H-4 zoning districts — nearly every district where a two-bedroom apartment exists. 17
Nebraska law backs that up at the state level. A municipality may not adopt a rule that prohibits the use of a property as a short-term rental, and may regulate one only where the primary purpose is public health and safety. 18 Read Chapter 5.39 for the licence and the conditional-use provisions of Title 27 for the address.
Mid-term signal. Lincoln's demand anchors — a university and a state government — place people into academic-year and agency leases rather than 13-week rotations, so a furnished 30-day-plus strategy is a thinner lever here than in the other two cities. Treat it as a backup tenant type rather than a plan.
Risks. The campus calendar drives a summer trough; budget for it. The conditional-use approval is address-specific, so a district-level green light is not an address-level one. And the state preemption that protects the model has held since 2019, which is a protection rather than a guarantee.
First 90 days. Weeks 1–2: pull the zoning district for two or three candidate addresses and confirm conditional-use treatment in writing with the city. Weeks 3–6: get signed landlord consent to sublet before you discuss rent, and price the unit against the 18-night model rather than a broker's projection. Weeks 7–10: licence the unit, furnish it, and list it for the September-through-November and spring game windows. Weeks 11–13: hold the first month's revenue in reserve and review occupancy against the 60% line.
Is this safe to start in the next 30 days? WAIT — one step out. Lincoln clears the spread, the licence, the zoning and the state law. Two things stand between the file and a yes: a written conditional-use confirmation for the address, and a landlord who will put subletting in the lease.

Non-owner-occupied certificate, $1,000 first year plus $400 renewal−$117

Regulation gate. Buffalo regulates short-term rentals under Chapter 380. Owner-occupied rentals are allowed as of right across most of the city, with the exceptions named in the code. A non-owner-occupied rental — the only kind an arbitrage operator runs — is not allowed without a special use permit under Chapter 496, section 11.3.3 of the Unified Development Ordinance, which goes to the Planning Board for a recommendation to the Common Council. Short-term rentals are also barred from apartment buildings, co-ops, condominiums and three-family units, which rules out most of the easy inventory. 21
The fee schedule is the tell. A non-owner-occupied certificate costs $1,000 in the first year and $400 a year after, against $500 and $200 for an owner-occupied one, and every property takes an annual inspection. Selling the property ends operations until the new owner holds a licence. 21 Read Chapter 380 sections 380-7 and 380-13, then chapter 496 section 11.3.3.
Mid-term signal. The medical campus makes Buffalo the strongest of the three for furnished 30-day-plus stays. Furnished Finder runs more than 300,000 listings nationwide with a three-month average stay, and about a quarter of its renters are healthcare workers on assignment. 22 A unit near the campus can hold a mid-term tenant between short stays, and the code's own ban on apartment and three-family buildings makes a legal, licensed flat scarce enough to rent twice.
Risks. The permit is the deal. Plan on 60 to 120 days and $1,000 before any rent is due, and expect the council to ask about neighbourhood impact. Winter is the trough month cluster, and Buffalo's seasonality score of 65 out of 100 is the least steady of the three. 23 The fee gap between owner-occupied and non-owner-occupied has widened, so read each year's schedule as a signal of appetite.
First 90 days. Weeks 1–4: confirm the address sits outside the barred districts and outside the multi-unit ban, then start the special use permit file. Weeks 5–10: attend the Planning Board hearing; this is the gate, and the calendar sets your lease start, not the other way round. Weeks 11–13: sign only after the permit is granted, furnish against the medical-campus rotation calendar, and list for a three-month minimum alongside nightly availability.
Is this safe to start in the next 30 days? WAIT. The spread holds at $256 a month, and the permit is the whole question. Thirty days is enough to file and not enough to be granted.

Huntsville, Alabama

Snapshot. Population 233,627. Two-bedroom asking rent $1,110. Market ADR $128, occupancy 60%. AirDNA Market Score 84, with the steadiest seasonality of the three. Regulation light: yellow. 101112
Where to look. Downtown and the medical district, where the city's hotel stock is thinnest and weekend demand concentrates. The Research Park corridor along Research Park Boulevard, next to Cummings Research Park — the second-largest research and technology park in the country, home to 300 companies with a combined workforce above 26,000 and anchored by the University of Alabama in Huntsville. 24

Alabama business licence, estimated−$25
Net monthly cash flow+$177
The licence line is the one estimate in this model. Alabama sets business licence fees on a gross-receipts schedule, so confirm your bracket with the city's Finance Department before you commit; a higher bracket moves this number by tens of dollars, not hundreds.
Regulation gate. Huntsville requires a city business licence for anyone renting a property short-term, including listings on Airbnb and Vrbo, and routes the application through all relevant departments — allow up to 10 business days. The zoning step comes first. Short-term rentals are treated as motels, and are generally not permitted in most residential districts. They are allowed as a primary use in Residence 2-B, General Business C-3, Highway Business C-4, Commercial Recreation C-5, Light Industry, Heavy Industry, Airport Industrial Park and Research Park Commercial, and by special exception in Neighborhood Business C-2, Village Business C-6, the Research Park districts and Airport Commercial. 25 Read the accessory-use provisions of the zoning ordinance, then Chapter 15, Articles II and III of the code of ordinances for the lodging tax.
That tax is 9% plus a $2 per room, per night surcharge, filed through the state's OneSpot portal rather than collected by the platform, so the money passes through your account before it reaches the city. 25
Mid-term signal. Contractor rotations into the research park and defence work are the mid-term demand here, and the 26,000-strong park workforce is a large pool for furnished monthly stays. 24 The city's near-perfect seasonality score of 97 out of 100 means the nightly calendar stays busy between rotations. 26
Risks. Enforcement here is real and recent. On May 26 a Madison County circuit judge signed a consent order and permanent injunction barring entities operating under the Patriot Family Homes brand from using seven Huntsville-area properties for transient lodging, all of them in residential zones where short-term rentals are prohibited. The order blocks them from advertising or listing those properties and requires a full accounting of rental revenue back to January 1, 2018 so the city can calculate unpaid lodging taxes, penalties and interest. 27 Check the zoning district before you look at the unit, and keep the licence and the lodging tax current from month one. The margin is the thinnest of the three, so a soft winter or a rate cut eats it.
First 90 days. Week 1: look up the parcel on the city's interactive zoning map and walk away from anything in a single-family district. Weeks 2–4: secure the business licence and confirm your gross-receipts bracket with Finance. Weeks 5–8: lease, furnish and list, pricing at the market ADR rather than above it. Weeks 9–13: file lodging tax monthly, and test a three-month furnished listing to cover the gaps between nightly stays.
Is this safe to start in the next 30 days? WAIT. Most addresses in this city fail the zoning test before the math even applies, and the maths leaves $177 a month of margin. Confirm the district first.

The downside

Every number above assumes 60% occupancy and the market's average nightly rate. Both move. Here is what happens when they do, holding all other costs fixed.
OccupancyLincolnBuffaloHuntsville
50% — 15 nights+$147−$137−$148

10% below market+$300+$20−$18
Market rate+$530+$256+$177
10% above market+$759+$491+$371
Lincoln carries the widest cushion: at 50% occupancy it still clears $147 a month, and a 10% rate cut leaves $300. Buffalo and Huntsville both turn negative at 50% occupancy, and Huntsville turns negative on a 10% rate cut. That is the whole argument for holding at least three months of the full cost stack in reserve before signing anything.
City30-day answerWhat would flip it
Lincoln, NEWAITA written conditional-use confirmation for the exact address, plus landlord consent to sublet in the lease
Buffalo, NYWAITA granted special use permit for the address; budget 60–120 days and $1,000 before rent starts
Huntsville, ALWAITAn address confirmed inside a primary-use zoning district, or a special exception in hand, before signing

Before you sign anything

  • Get the zoning district in writing for the exact address. A city-level green light is not an address-level approval in any of these three.
  • Put subletting in the lease and keep it there. Verbal permission ends when the landlord sells.
  • Hold three months of the full cost stack in reserve. At 50% occupancy, two of these three cities run negative.
  • Confirm who collects the lodging tax. Huntsville's 9% plus $2 a night is filed by the operator; if the platform does not collect it, it comes out of your account first.
  • Re-run the P&L with your actual rent quote and your actual furnishing budget. The $6,000 furnishing figure is an assumption, and it is the line most operators underrun.
  • Check the operator side yourself. No public disclosure in any of these three cities this week met this channel's test of an operator running three or more units profitably in the past twelve months, so peer validation is still open for all three.
Lincoln is the file to work. Buffalo is the one to file and wait on. Huntsville is the one to check the map on before anything else.
